GWGL (Girls WA Group Link) respects the intellectual property rights of others. We expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our service.
We are a Directory Service. We do not host the WhatsApp groups themselves. We do not control the files, chats, or media shared inside those groups. Those reside on servers owned by Meta (WhatsApp). We only host the invite link and the group icon (thumbnail).
1. Our Position as a Service Provider
We operate under the safe harbor provisions of 17 U.S.C. ยง 512. We are a platform where users submit content (UGC). We do not actively monitor every piece of content for copyright infringement, but we take strict action when notified.
If you believe a group icon (thumbnail) or a description on our site infringes your copyright, we can remove that specific listing from our directory. However, we cannot "shut down" the WhatsApp group itself. For that, you must contact WhatsApp/Meta directly.
2. Submitting a Takedown Notice
If you are a copyright owner, or authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of the Notice as described below, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from the Site.
Your Notice MUST Include the Following:
- Identification of the work: A description of the copyrighted work that you claim has been infringed. If multiple works are covered, provide a representative list.
- Identification of the material: The exact URL(s) on our website (https://girlswagroup.link/...) where the infringing material is located. "The whole site" is not a valid description.
- Contact Info: Your address, telephone number, and email address.
- Statement of Good Faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
- Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
3. Where to Send the Notice
Please send your DMCA notices via email. We prioritize these requests.
Email: [email protected]
Please note: If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.
4. Counter-Notice Procedure
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice. To be effective, a Counter-Notification must be a written communication provided to our Designated Agent that includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located.
- Your physical or electronic signature.
5. Repeat Infringers
It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers. If we detect multiple valid DMCA complaints coming from the same IP address or user account, we will permanently ban that user from submitting future groups.
6. Modifications
We reserve the right to modify the contents of this page and our policy for handling DMCA claims at any time for any reason. You are encouraged to check back to review this policy frequently for any changes.
